Child Custody Law

The Rhode Island family court judge uses the standard of "best interests of the child" in children of Rhode Island and the visitation of child custody cases. Factors a judge of the Court of family should use in making a determination of "best interests of the child" are exposed in the case of seminal Rhode Island of Pettinato v Pettinato, 589 child custody issues A.2d 909 (R.I. 1990), the visitation and placement are generally determined by the Court of the family of Rotary International in divorce, divorce, post paternity, DCYF, right to family and child custody cases.

Legal custody basics

The Rhode Island family court judge may grant or legal exclusive custody to a parent or may grant joint legal custody to both parents. The question of legal custody is completely separate from the question of the visit. RI visitation rights fall outside the scope of this article by Rhode Island law. Please consult with Rhode Island child custody lawyer David Slepkow on the facts of your case.

Sole legal custody

Sole legal custody means that a father can do all the important and major decisions concerning the health, welfare and education of a child without consulting with the other parent. These decisions include decisions of well-being of the religious, educational, medical and General. The parent with sole custody of the child will also have the physical location of the child. The parent with sole legal custody has full access to education, medical records and other child-related.

Joint legal custody

Joint legal custody means that both parents should be involved in major decisions / important concerning the upbringing of a child, education, medical and religious welfare. Theoretically, both parents with joint custody have equal rights in important decision-making with respect to their child or children. Both parents are fully entitled to access to all educational, medical records and other child-related. In order to joint custody that is viable, parents should have certain level of communication and respect for each other to enable them to co-parent.

Physical location - physical custody

The Court must also give the physical location of one of the parents of the child or children. Physical location is where the child will live on a daily basis. Physical location is also known as "physical custody" father has physical custody of the child will have reasonable visitation rights. The father with the physical location of a child is entitled to Rhode Island child support parent who have visitation rights. Child support is normally determined by the Rhode Island child support guidelines

Share physical location

Shared (shared physical custody) physical location is when the child divides time residing with parents. Shared physical location is relatively rare in Rhode Island. In some cases the child can be placed with one of the parents for half of the week and then the other half of the week parent. Some parents alternates weeks or months. This type of arrangement is generally only done by agreement of the parties, and rarely is ordered by the Tribunal absent an agreement.

Physical location of split

Physical placement Division is when a child lives with father and a child lives with mother. You may also when children are divided into distance so that at least one child living with a parent and at least one child living with the mother.

If the parents are not according to the legal custody of the physical location or the visitation and then the family of Rotary International Tribunal must determine what is in the "best interests of the child" is very subjective and analytical standard.
