If Pennington County, two grandparents sought custody to his grandson after the child's parents broke up.
The Chamber judge threw their request after ruling that State laws allow non-parents find unconstitutional detention. But the Supreme Court says could get law because it requires that the courts give particular weight to decisions fit parents.
The ruling means hold status will continue in the trial court.
